Opposing appeals rulings regarding ACA insurance subsidies    

On Tuesday, July 22, a three-judge panel of the D.C. Circuit Court of Appeals ruled that the Affordable Care Act only offers insurance subsidies to states running their own exchanges and not those using federally facilitated marketplaces. Later that day, however, the Fourth Circuit Court of Appeals ruled that the federally run exchanges would be eligible for subsidies.
If the D.C. Circuit Court of Appeals’ ruling is upheld, enrollees in states that chose to use federally run exchanges rather than set up their own state exchange would no longer be eligible for tax subsidies.
The administration plans to appeal the ruling to a full panel of the D.C. Circuit Court.
We understand that a ruling such as the one issued by the D.C. Circuit Court of Appeals could affect hundreds of thousands of New Jersey residents and AmeriHealth New Jersey insured individuals. We will continue to monitor this issue closely and keep you updated as it develops.
